National food safety standards for the identification and quality of whey for national and international trade will be developed with the intention being that the industry and public shape the direction of the legislation.

Currently the only rules applying to whey date back to 1985 and relate solely to transportation and handling.

The reason for this basic legislation, the government has said, relates to whey historically being treated as an industrial waste product with very little of it being utilised in the food industry.

But usage patterns have changed with whey being included as an ingredient in processed milk drinks, chocolate, dariy compounds and dietary supplements for athletes.

By using a public base for consultation, the government has said a democratic and transparent regulation will be formulised.
